The Starkville Planning and Zoning Commission will consider multiple requests at its 5:30 p.m. Tuesday meeting at City Hall, including two rezonings for mobile home use and three requests from churches.
Shenestia Thompsonâ€™s request to replace a manufactured home at 1646 Rockhill Road is back before the commission after its tabling Feb. 14. Carissa Hendrix is also requesting permission to place a mobile home at 1587-2 Bluefield Road, and both requests require rezonings from R-1 (single-family residential) to R-M (mobile home).
The commission tabled Thompsonâ€™s request Feb. 14 when questions arose about the parcelâ€™s ownership. City Attorney Chris Latimer said when city staff investigated the ownership, it was listed as owned by the Thomas Brooks estate. No clear heirs were outlined.
Latimer said Thompson needed to consult a lawyer to receive a determination of heirs, a legal document which would assure the city of Thompsonâ€™s legal property inheritance. Latimer said Thompson would also need a court to determine who can legally sign documents pertaining to the estate, including the rezoning application.
â€śOnce the city has those two documents, it will be able to move forward with the rezoning,â€ť Latimer said. â€śI know no applicant wants a delay, but the cleanest thing to do legally would be to give the applicant time to come up with this proof of ownership, and to delay any further proceedings to give them time to do that.â€ť
In plannerâ€™s reports for both Thompsonâ€™s and Hendrixâ€™s requests, Assistant City Planner Pamela Daniel makes a distinction between the R-6 zoning the planning office has recommended to allow placement of mobile homes in the past and the R-M zoning the office recommends for these two properties. Both reports say a recent public hearing for a rezoning from R-1 to R-6 (mobile homes) â€śfostered some citizen discontent,â€ť leading the planning staff to use R-M as an alternative to R-6.
â€śThis (R-M) classification does not permit by right, or allow by conditional use, mobile home parks or mobile home subdivisions,â€ť both reports say. â€śHowever, it does permit by right individual mobile and manufactured homes on lots with a minimum area of 10,000 square feet.â€ť
The commission will also consider a request from New Horizons Christian Fellowship to establish a place of worship in a C-2 (general business) zone at 60 Lynn Lane, south of Starkville High School. The Starkville School Board of Trustees granted NHCF an easement for ingress and egress across school district right of way for the proposed church property at its meeting March 6.
According to City Planner Ben Griffithâ€™s report on the item, the Josey family originally owned the property and deeded a tract of land to NHCF. The city approved a plat for this lot in April 2005. Then, the report says, the Josey family deeded a second adjacent lot to NHCF, giving NHCF enough space to meet the 3-acre minimum lot size for building a church. Therefore, the agenda calls for the commission to consider a final plat for a subdivision including both lots immediately after NHCFâ€™s first request.
Second Missionary Baptist Church is also requesting permission to expand its place of worship at 314 Yeates St.
Finally, the commission will consider a request from Michael Valentine to establish an outpatient drug and alcohol treatment therapy center with no overnight stays at 905 Louisville St., east of United Produce.
